MOVE 2 IMPROVE – Terms & Conditions (UAE)

These Terms & Conditions apply to all MOVE 2 IMPROVE services provided by Leadflow Consulting - FZCO, located in IFZA Business Park, DDP, Premises Number 62412-001 and under the Trade License No. 62412. These terms & conditions include Personalized Mentoring, Workout Plans, and Live Online Group Classes. By purchasing or participating in any service, you confirm that you have read, understood, and agreed to these Terms.

1. Nature & Scope of Services

MOVE 2 IMPROVE is a lifestyle-based movement service designed to support general wellbeing, movement confidence, and physical conditioning. It is not a medical or healthcare service.

MOVE 2 IMPROVE provides:

  • Exercise guidance and programming
  • Movement education
  • Lifestyle-oriented coaching based on physiotherapy principles, Pilates, and strength training

MOVE 2 IMPROVE does not provide:

  • Medical diagnosis
  • Medical treatment
  • Rehabilitation services
  • Emergency or urgent care

Participation is entirely voluntary and at your own risk. MOVE 2 IMPROVE does not replace advice or treatment from a licensed physician or healthcare professional. Clients are strongly advised to seek medical clearance before starting any exercise program.

2. No Guarantees

Results vary between individuals. MOVE 2 IMPROVE does not guarantee:

  • Pain-free outcomes
  • Recovery from injury
  • Performance, aesthetic, or fitness results

Progress depends on consistency, lifestyle, and individual response.

3. Client Responsibility & Assumption of Risk

By participating in MOVE 2 IMPROVE services, you acknowledge and agree that:

  • MOVE 2 IMPROVE is a lifestyle service, not a healthcare service
  • Physical exercise and movement involve inherent risks
  • You voluntarily assume all risks associated with participation
  • You are solely responsible for monitoring your body and stopping any activity that causes sharp, worsening, or unusual pain

MOVE 2 IMPROVE is not responsible for injuries, health issues, or damages resulting from participation, misuse, lack of disclosure, or failure to follow guidance.

4. Health Disclosure & Pregnancy

Clients must disclose all relevant injuries, medical conditions, surgeries, pain, or limitations before starting and update this information if circumstances change.

Pregnancy must be disclosed prior to participation. MOVE 2 IMPROVE does not provide pregnancy-specific medical guidance. Participation during pregnancy is voluntary and at the client’s own risk.

5. Limitation of Liability

To the maximum extent permitted by UAE law, MOVE 2 IMPROVE’s liability is limited to the total amount paid by the client for the specific service purchased.

6. Governing Law & Jurisdiction

These Terms & Conditions are governed by and interpreted in accordance with the laws of the United Arab Emirates. UAE law applies regardless of the client’s country of residence.

Any dispute, controversy or claim arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be finally settled by arbitration under the Rules of the Dubai International Arbitration Centre (DIAC), which Rules are deemed to be incorporated by reference into this clause.

The seat of arbitration shall be Dubai, United Arab Emirates.

The language of the arbitration shall be English.

The arbitration shall be conducted by one (1) arbitrator.

The decision of the arbitrator shall be final and binding on the parties.

PART A — PERSONALIZED MENTORING TERMS

7. Nature of Mentoring

Personalized mentoring includes individualized exercise programming, guidance, and periodic adjustments. It does not include:

  • Continuous supervision
  • Immediate responses at all times
  • Emergency support

Mentoring is a collaborative process.

8. Communication & Response Times

Mentoring communication is primarily provided via WhatsApp.

  • Clients may send up to 20 messages per week.
  • Responses are provided within a maximum of 12 working hours (working hours are considered Monday to Friday, 9am until 6pm GST), depending on availability.
  • Response times may vary due to travel, time zone differences, or operational circumstances.

Immediate responses are not guaranteed.

9. Program Delivery

Personalized programs are delivered within 5 working days after the initial consultation. Plans are reviewed and updated approximately every 6 weeks, based on progress.

10. Exercise Videos & App Use

Programs are delivered via the Trainerize app. All exercise videos and training materials are provided for educational and informational purposes only and must be reviewed by the Client prior to performing any exercise.

The Client acknowledges and agrees that all exercises are performed at their own risk.

Move 2 Improve does not assume any liability for injuries, damages, or losses resulting from the performance of exercises demonstrated in the exercise videos.

The exercise videos are intended solely as general guidance and do not constitute a guarantee that the exercises are suitable, safe, or appropriate for every individual. Individual physical condition, limitations, and health status may vary.

The Client is solely responsible for ensuring correct exercise execution and for stopping any exercise that causes pain, discomfort, or injury, and for seeking medical advice where appropriate.

11. Payments, Membership Term, Cancellations & Refunds

11.1 Minimum Commitment Period

All MOVE 2 IMPROVE services offered as a membership or recurring payment are subject to a minimum commitment period of three (3) months. Cancellations are not permitted during this initial three-month period.

11.2 Cancellation Notice

After the minimum commitment period has been completed, clients may cancel their membership only if:

  • Cancellation is requested at least seven (7) days before the next scheduled automatic payment, and
  • The cancellation request is submitted in writing by email to the official MOVE 2 IMPROVE contact address: [email protected].

Cancellation requests sent through other channels (including WhatsApp, social media, or verbal communication) will not be considered valid.

Failure to cancel within this notice period or through the correct channel will result in the next payment being charged in full.

11.3 No Refund Policy

All payments made to MOVE 2 IMPROVE are non-refundable, including but not limited to:

  • Once a personalized exercise plan has been delivered
  • Once access to live or recorded online classes has been granted
  • Missed sessions, classes, or unused services

This policy applies regardless of usage, participation level, or personal circumstances.

11.4 Legal Basis (UAE Law)

This cancellation and refund policy is established in accordance with applicable principles of UAE Federal Law, including consumer and contract law provisions that permit non-refundable services once digital content, customized services, or access has been provided.

By purchasing MOVE 2 IMPROVE services, you expressly acknowledge and agree to these payment, cancellation, and refund terms.

PART B — LIVE ONLINE GROUP CLASSES TERMS

12. Group Class Nature

Live classes are not personalized. They provide general guidance and motivation in a group setting.

13. Camera & Corrections

Camera use is optional. Corrections or cues are not guaranteed due to group size and visibility limitations.

14. Eligibility & Equipment

Clients confirm they have completed the eligibility quiz honestly and will use appropriate equipment (bands and dumbbells) safely in a suitable environment.

15. Scheduling, Recordings & Service Continuity

Live class schedules may be adjusted when necessary. Any changes will be communicated in advance whenever possible.

If live classes are temporarily unavailable due to holidays, emergencies, or operational reasons, recorded sessions will be made available to all active members during that period. Recorded content remains accessible until the regular live schedule resumes.

16. Refunds & No-Pause Policy

  • Memberships are billed monthly via Stripe as recurring subscriptions.
  • All memberships are subject to a minimum commitment period of three (3) months.
  • Membership pauses or freezes are not permitted.
  • All payments are non-refundable, regardless of usage, attendance, travel, illness, or personal circumstances.

17. Intellectual Property

All content, programs, videos, and the MOVE 2 IMPROVE method are for personal use only and may not be shared, recorded, or redistributed.

18. Termination of Services

MOVE 2 IMPROVE reserves the right to immediately suspend or terminate services, without refund, if a client:

  • Engages in unsafe behavior
  • Fails to comply with instructions or terms
  • Violates boundaries or behaves disrespectfully

19. Privacy, Data & Platforms

A separate Privacy Policy applies and governs the collection and processing of personal data. Communication via WhatsApp and use of third-party platforms (including Trainerize, Zoom, Stripe) may involve external data handling beyond MOVE 2 IMPROVE’s direct control.

20. Acknowledgement & Consent

By purchasing or participating in MOVE 2 IMPROVE services, you confirm that you:

  • Have read and understood these Terms & Conditions
  • Understand MOVE 2 IMPROVE is a lifestyle service, not a medical service
  • Voluntarily assume all risks related to participation
  • Agree to comply with all conditions set out above
